Claims, counterclaims in breach of contract litigation

It began life as San Diego Stadium, but has gone through a laundry list of names since then, from Jack Murphy Stadium to Qualcomm Stadium to today’s SDCCU Stadium. Regardless of what you call it, the giant multi-purpose facility has more than once been the focus of litigation.

We read recently of a stadium that is almost the exact opposite of our aged stadium: the brand-new facility is at the other end of the country. But according to news reports, Dunkin’ Donuts Park is the centerpiece of bitter construction litigation involving claims of breach of contract and more.

A trial is scheduled to begin this week between the city of Hartford, Connecticut, and the fired former developer of the stadium.

The former developer is asking for $90 million in its lawsuit that it was wrongfully terminated.

The former developer – Centerplan Construction Co./DoNo Hartford LLC – was hired back in early 2015 by the city to develop a home for the minor league Hartford Yard Goats baseball team. But problems with construction and other issues led to delays and a $10 million cost overrun. Worse, the Yard Goats had to play their inaugural season on the road – they were unable to play a single game at home.

The problems apparently prompted the city to fire Centerplan and DoNo Hartford LLC in the middle of 2016. That, in turn, prompted the companies to file their lawsuit. And that eventually led to a counterclaim filed by Hartford against the companies in the latter half of 2017. The countersuit alleges breach of contract, negligence and professional malpractice.
